Senator Romano moved to amend the amendment on page one, section three, by striking out all of subsection (a) and inserting in lieu thereof a new subsection, designated subsection (a), to read as follows:


(a) Any person who carries a concealed deadly weapon, without a state license or other lawful authorization established under the provisions of this code, shall be is guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than $100 nor more than $1,000 and may be imprisoned in the county jail for not more than twelve months for the first offense; but upon conviction of a second or subsequent offense, he or she shall be is guilty of a felony and, upon conviction thereof, shall be imprisoned in the penitentiary a state correctional facility not less than one nor more than five years and fined not less than $1,000 nor more than $5,000.;


On page two, section four, subsection (a), after the words “for the license” by changing the comma to a period and striking out the words “and pay to the sheriff, at the time of application, a fee of $75, of which $15 of that amount shall be deposited in the Courthouse Facilities Improvement Fund created by section six, article twenty-six, chapter twenty-nine of this code.”;

On page six, section four, subsection (g), by striking out the following: Before any approved license is issued or is effective, the applicant shall pay to the sheriff a fee in the amount of $25 which the sheriff shall forward to the superintendent of the West Virginia State Police within thirty days of receipt.;

On page nine, section four-a, subsection (a), after the words “provisional license” by changing the comma to a period and striking out the words “and pay to the sheriff, at the time of application, a fee of $25, of which $5 of that amount shall be deposited in the Courthouse Facilities Improvement Fund created by section six, article twenty-six, chapter twenty-nine of this code.”;

On page twelve, section four-a, subsection (g), by striking out the following: Before any approved license is issued or is effective, the applicant shall pay to the sheriff a fee in the amount of $15 which the sheriff shall forward to the superintendent of the West Virginia State Police within thirty days of receipt.;

And,

On page nineteen, section seven, by striking out all of subsection (c) and relettering the remaining subsections.
